These Terms & Conditions (“Terms”) govern your access to and use of the website www.rhythmsofgrace.ph and related services (the “Services”) operated by Rhythms of Grace Novelty Shop (“Rhythms of Grace,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use our Services.

1. Eligibility

By using our Services, you confirm that you are at least eighteen (18) years old or accessing the Services under the supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete information when placing orders or creating accounts.

2. Products & Representation

We make reasonable efforts to display product details accurately. However:

  • Colors may vary depending on device screens.
  • Slight variations in print placement may occur.
  • Measurements may have a tolerance of ±1–2 cm.
  • Fabric texture and appearance may vary slightly by batch.

We reserve the right to modify or discontinue products at any time without prior notice.

3. Production & Availability

Certain products are prepared upon order to maintain quality and responsible production practices.

Processing times are estimates only and may vary due to:

  • Order volume
  • Launch periods
  • Supply availability
  • Operational limitations

We reserve the right to decline or cancel orders at our discretion. Orders are confirmed only after successful payment verification.

4. Orders & Acceptance

Placing an order constitutes an offer to purchase. An order is accepted only when payment is confirmed and processing begins.

We reserve the right to:

  • Refuse service
  • Limit quantities
  • Cancel orders suspected of fraud
  • Cancel unpaid orders
  • Cancel orders that violate these Terms

5. Pricing & Payments

Prices are listed in Philippine Pesos (PHP) unless otherwise stated.

Prices do not include shipping fees, customs duties, or import taxes (if applicable).

Payments are processed via:

  • Shopify-integrated card processors
  • GCash
  • Maya
  • Bank transfers

We do not store full card information.

Failure to complete payment may result in automatic order cancellation.

6. Shipping & Risk Transfer

Delivery timelines are estimates only and not guaranteed.

We are not liable for delays caused by:

  • Courier partners
  • Weather conditions
  • Customs processing
  • Events beyond our control

Risk of loss transfers to the customer once the order is handed to the courier.

7. Customization & Pop-Up Services

For on-site customization at pop-up events:

  • Customers may bring their own cotton garments for DTF application.
  • Garments must be compatible (cotton or high cotton blend).
  • We are not responsible for fabric quality, shrinkage, or damage resulting from application to customer-provided garments.
  • Design selection is limited to approved Rhythms of Grace designs.
  • On-site customization services are final and non-refundable.

We reserve the right to refuse customization requests that are unsuitable for application.

8. Intellectual Property

All original designs, concepts, brand elements, product names, written content, layout, typography, product arrangements, photography, graphics, and overall presentation of products on the Services are the exclusive intellectual property of Rhythms of Grace and are protected under applicable intellectual property laws.

Certain artwork or graphic elements used in some products may be licensed from third-party creators under valid commercial licenses. Such licensed elements remain the intellectual property of their respective owners and are used in accordance with the terms of those licenses.

Unless expressly permitted in writing, you may not reproduce, copy, modify, digitally replicate, recreate, extract, adapt, distribute, resell, create derivative works from, use for commercial purposes, or commercially exploit any original designs, concepts, content, product arrangements, or brand materials displayed on the Services, in whole or in part.

This includes, but is not limited to:

  • Downloading or extracting design files
  • Recreating designs from product images or mockups
  • Converting displayed artwork into printable or digital files
  • Using screenshots to reproduce artwork
  • Sending designs to third-party printers
  • Using our designs for resale, commercial merchandise, or marketplace listings

Unauthorized reproduction, redistribution, commercial use, or resale of our products or designs, whether in whole or in part, is strictly prohibited.

We reserve the right to pursue appropriate legal remedies for infringement, misuse, or unauthorized commercial exploitation.

9. Marketplace Sales

Products purchased through Shopee, Lazada, TikTok Shop, or other marketplaces are subject to those platforms’ respective policies in addition to these Terms.

We are not responsible for disputes governed by third-party platform rules.

10. Prohibited Use

You may not use the Services:

  • For unlawful purposes
  • To infringe intellectual property
  • To engage in fraudulent activity
  • To interfere with website security
  • To scrape or extract data

We may suspend or terminate access if these Terms are violated.

11. Disclaimer of Warranties

The Services and products are provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted access, error-free operation, or that products will meet subjective expectations.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by applicable Philippine law, Rhythms of Grace shall not be liable for indirect, incidental, or consequential damages arising from:

  • Use of the Services
  • Product use
  • Shipping delays
  • Third-party platform interactions

Our total liability shall not exceed the amount paid for the product in question.

13. Indemnification

You agree to indemnify and hold harmless Rhythms of Grace from claims arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your infringement of third-party rights

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes shall be subject to the exclusive jurisdiction of the proper courts of the Philippines.

15. Force Majeure

We shall not be liable for failure or delay in performance due to events beyond our reasonable control, including natural disasters, typhoons, acts of government, supply chain disruptions, or courier interruptions.

16. Changes to These Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of any revisions.
